1.1. Harvey Norman Stores (N.Z) Pty Limited (“Harvey Norman”, "our", "us", or "we") is the owner and operator of this website www.harveynorman.co.nz. Theses Online Sale Terms and Conditions (“Sale Terms”) together with our Website Terms and Conditions of Use, Returns Policy, Click and Collect and Delivery Terms, and our Privacy Policy (collectively “Terms and Conditions”) apply to the ordering, purchase, fulfilment and delivery of goods and services from the website.
1.2. In these Sale Terms the following definitions apply: "Order" means any offer made by you, in response to an invitation to treat made by us via the website; “third party” includes any agent or contractor of Harvey Norman or of any of our related bodies corporate, and any person engaged by any us, in the creation, provision or maintenance of the website, or the fulfilment and delivery of Orders made via the website, and includes any of them; “website” means www.harveynorman.co.nz; “you” means anyone who accesses and/or uses the website.
2.1. By accessing the website or placing an Order for goods or services, you agree to these Sale Terms. Please read the Sale Terms carefully before placing your Order as they contain important information about your online purchase. If you do not accept these Sales Terms, or any of the other Terms and Conditions, you must refrain from using the website or making an Order from the website.
2.2. Any information contained on the website constitutes an invitation to treat and is not an offer to supply any goods or services. Any Orders you place via the website are legally binding offers and if accepted by us, a legally binding contract is formed between you and Harvey Norman.
3.1. You may access and/or order goods and services from the website either as a guest or as a Harvey Norman account holder. You must be eighteen (18) years of age or over to create an account or purchase goods or services from the website.
3.2. If you wish to create an online account with us, please complete the online form Register for a New Account. We only permit one account registration per email address. Any personal information provided by you when creating an account with us, will be managed in accordance with our Privacy Policy. If you do not provide us with accurate and complete information, we may not be able to activate your online account.
3.3. After you have created your online account, you will receive an email from us. If you have not received an email within 24 hours, please contact our Online Customer Services Team.
3.4. You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorised use of your password or account. If you forget your password, you may click on the relevant link located on the website and we will email you a link to create a new password. Alternatively you may contact our Online Customer Services Team.
3.5. You also agree to keep your account details current at all times by updating your account via our website or by contacting our Online Customer Services Team. You must not use another user’s account without their permission.
3.6. We reserve the right to terminate an account immediately without notice, for any reason, including without limitation, where we suspect the account holder has breached these Sale Terms or the Website Terms and Conditions of Use.

You will then be asked to confirm the details of your Order and your preferred delivery or collection options. After you have provided your delivery details, your delivery charges will be automatically calculated and displayed on the checkout page prior to payment. 5.5. After making payment, we will send you an email confirming receipt of your Order and a summary of your Order. This email is an acknowledgement that we have received your Order and does not confirm acceptance by us of your offer to purchase the goods ordered. If your Order is not accepted by us, or if we need to cancel your order in accordance with clause 5.9 and 6.4 below, we will notify you by telephone or email and arrange for a full refund of any payment made by you.
5.6. Special Order Goods - Some goods are only available to purchase by special order, meaning that they are made to order especially for you. These products may not be stocked in all stores and will need to be ordered in from our supplier. Details of whether a good is ‘made to order’ or ‘available by special order’ is provided on the product page. We will call you to confirm details of your Order, availability, and advise you of estimated delivery time frames. Please note that as these goods are specifically ordered for you, you can only cancel or change your order within 5 working days from the date of the Order. Upon the expiry of this time frame, cancellation or changes of your Order shall not be permitted, unless the CGA or other consumer laws apply.
5.7. Restricted Goods - Some goods sold via our website have an age restriction. By placing an Order for any age restricted goods, you acknowledge that you are of at least the minimum age required for purchase, use and viewing, and that you are not obtaining the goods on behalf of a person who is not the appropriate age.

We will use reasonable endeavours to change or cancel your Order, provided that your Order is not ready for delivery or collection in store. If your Order is cancelled, a full refund of any payments made for that Order, will be issued to you, using your original payment method. If your Order has already been delivered or collected from store, you cannot change or cancel your Order, and you will need to follow our Returns Policy in this regard. This clause does not limit any rights and remedies you may have under clause 12 or at law.

Due to the size of our stores and the popularity of goods, promotions or special prices, goods advertised on the website may vary from what is on display, offered or available for purchase from any of our retail stores, and in some cases may only be available online. Harvey Norman does not guarantee the availability of any specific goods at any time for purchase, either online or in-store. Please call your local Harvey Norman store to enquire whether they have the items on display or are available to purchase.
6.2. We have made reasonable efforts to provide accurate stock availability information on the website, however we do not guarantee that if goods are classified as being “in stock” that stock will be available to purchase online or in store.
6.3. You acknowledge that stock availabilities are subject to change. If we are unable to supply a particular good which has been ordered by you, we will notify you by telephone or email as soon as possible.
6.4. We may limit the quantities of goods purchased per person, per household or per order. These restrictions include orders from the same user account, credit card and orders that use the same billing and/or delivery address. We reserve the right to prohibit commercial and trade sales, and sales to resellers. If we reasonably believe, any order is in breach of this clause, we reserve the right to cancel the order.
7.1. All prices for goods and services on the website are displayed in New Zealand dollars and include GST (where applicable). Prices displayed are available in New Zealand only and do not include delivery, set-up, installation and handling charges. Prices are valid until amended or removed from the website and are subject to change.
7.2. We have taken reasonable efforts to provide accurate pricing information on the website and any prices that are displayed incorrectly are not valid. We reserve the right to correct any pricing errors or alter the prices on our website and in store at any time, for any reason, without notice to you. Prices are subject to change by individual Harvey Norman stores and prices displayed may vary in different regions and stores.
7.3. Images of goods shown without any advertised price beside that image, are not offered for sale. Unless otherwise stated, accessories shown in any images of goods are not included in the price and may not be available for purchase online and/or in-store.
7.4. Each published saving in respect of a goods or services advertised on the website, is stated to be by reference to our normal ticketed price.
8.1. Payment in full must be made at the time you place your Order with us. We currently accept Visa, Visa Debit Cards, Mastercard, American Express, American Express Membership Rewards Points, Gem Creditline, Gem Visa, Afterpay, PayPal and Harvey Norman Gift Cards, as forms of payment for online transactions. We reserve the right to change the payment methods that can be used for Orders at any time in our absolute discretion.
8.2. For payments by credit card, you authorise us (via our third-party agents) to charge your credit card account for the total price of the goods ordered and any applicable delivery fees, as detailed in your Order summary. All payments must be made via the TNS secure payment gateway facilities accessible via the website and will be subject to any terms and conditions of these providers. To secure our payment systems, the website employs the latest in Secure Sockets Layer technology from the TNS secure payment gateway.
8.3. Your offer to purchase and make payment for goods and services from us, is subject to fraud analytic pre-screening which is administered by third party service providers including Forter Australia Pty Ltd, or any other fraud analytic pre-screening used by us from time to time.

8.5. To the maximum extent permitted by law, we will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by you where a credit card, debit card, PayPal, or Afterpay account is used in a fraudulently or unauthorised manner.

9.1. Subject to your compliance with these Sales Terms and our acceptance of your Order, we will sell and supply the products to you as shown on your Order confirmation.
9.2. When you complete your Order, you will be prompted to select whether you wish to collect your Order from a Harvey Norman store (“click and collect’) or to have the Order delivered to an address specified by you. Customer Direct items are delivered directly to you by a trusted supplier and are not available for click and collect.
9.3. Delivery charges (if any) are payable in addition to the price for the goods subject to an Order. The final delivery charges are automatically calculated and displayed on the checkout page prior to payment. The delivery charges are based on the items’ weight and size, and the distance between your shipping address and the nearest Harvey Norman store. You can see an estimate delivery cost on the items’ product page, by entering your address in the “For delivery estimate and stock availability” section.
9.4. Deliveries to the outer islands of New Zealand may incur additional delivery fees. Please contact one of our stores before placing your Order for more details.
9.5. It is your responsibility to advise us at the time you place your Order, or later when you discuss delivery with us, of any access issues that may be involved in the delivery, such as remote rural locations, restricted access, lifts, stairs, or narrow entries. If you do not state the situation correctly, additional delivery charges may be incurred by you.
9.6. When you place an Order for goods to be delivered, you will be required to enter your delivery address details. The delivery address must be an address within New Zealand and cannot be a PO Box or a freight forwarding location. It is your responsibility to ensure that the correct delivery address is provided to us. All Orders are sent by courier or delivery contractor and require a person present to accept the delivery. If an Order cannot be delivered:
9.7. If the goods that you have ordered are in stock, we will use reasonable endeavours to deliver small to medium items within 3-5 business days of the date you placed your Order. For larger furniture, bedding, and electrical items in stock, we will use reasonable endeavours to deliver your Order within 10 business days. We will contact you by telephone or email to arrange a suitable delivery time. Please allow more time if your delivery address is a remote or rural location.
9.8. Please note that customised and special-order goods, and some large furniture, bedding and electrical items are not held in stock and will be required to be ordered in store. You acknowledge and agree, that your Order for customised goods or large furniture, bedding and electrical items may take up to 16 weeks to be delivered to you from the date you placed your Order. This timeframe is the average manufacturing lead time required by suppliers. We will contact you on receipt of your Order to notify you of the indicative delivery date.
9.10. Goods may not be available for immediate delivery. Delivery times are approximate only and are subject to stock availability, the dimensions of the goods and the location of your address. We will use reasonable endeavours to deliver your Order within any stated delivery timeframes and will not be liable for any loss, expense or damage resulting from the delay in delivery or failure to deliver. This clause does not limit any rights you may have under clause 9.11, nor any of your legal rights or remedies as referred to in clause 15.5.
9.11. If after receiving your Order we determine that we are unable to deliver your Order within 28 business days of receipt of your Order, for whatever reason, we will contact you by telephone or email to give you the option of cancelling your Order and receiving a full refund of the price paid for the Order.
9.12. If you arrange your own delivery or collection, then the goods becomes your responsibility upon collection from store.
10.1 When you place your Order and the goods are in stock, you can elect to have your goods collected from a Harvey Norman store nominated by you. The store will contact you by telephone or email to notify you when the Order is ready for collection. Customer Direct items are delivered directly to you by a trusted supplier and are not available for click and collect.
10.2. When collecting the Order from store, you, or the person collecting the Order:
10.3. You, or the person collecting the Order, acknowledges that we may record the identification details provided at the time of the collection of the Order, in accordance with our Privacy Policy. Please note that we will not take copies of any identification documents provided by you.
10.4. Click and collect orders must be collected within 21 days of the relevant Harvey Norman store giving you notice that your Order is ready for collection. If your Order is not collected within this timeframe, the relevant Harvey Norman store has the right to cancel the contract for sale, by notice to you and provide you with a full refund. If you are unable to pick up within this time frame, please contact your nominated click and collect store.
10.5. All click and collect orders are subject to our Click and Collect Terms.
11.1. Title and risk in the goods passes to you when full payment has been made, and on delivery of the goods to the delivery address provided in your Order, or collection of the goods from a Harvey Norman store.
12.1. Harvey Norman is committed to ensuring that all goods sold are of high quality. If any goods ordered by you arrive damaged, are incorrect, or are not of acceptable quality, you may have legal rights and remedies under the Consumer Guarantees Act 1986 (“CGA”). Please contact either our Online Customer Services Team or the Harvey Norman store fulfilling your order.
12.2. Please refer to our Returns Policy for more information regarding online orders when you have changed your mind or the goods were not what you expected.
13.1. We accept all Harvey Norman Physical Gift Cards, eGift Cards and Bonus Gift Cards (“Harvey Norman Gift Cards”) as a payment option for any Order. Harvey Norman Gift Cards are subject to the Gift Card Terms and Conditions which can be found at www.harveynorman.co.nz/gift-card-terms-and-conditions.html.
13.2. A maximum of five (5) Harvey Norman Gift Cards can be redeemed online per Order.
13.3. Harvey Norman Physical Gift Cards can be purchased at any Harvey Norman Store or from our website. eGift Cards can be purchased from the website or by contacting our Gift Card team at nzgiftcards@nz.harveynorman.com.
13.4. Physical Gift Cards purchased from the website are delivered to the residential or business address within New Zealand specified in your Order. They cannot be delivered to a PO Box. Please ensure you enter the correct delivery address for the Physical Gift Cards, as we will not be able to reissue or cancel a Physical Gift Card that has been sent to an incorrect delivery address and subsequently redeemed by another person. You will need to activate the Physical Gift Card before being used by contacting our Gift Card Team.
13.5. eGift Cards purchased from the website or via our Gift Card Team, will be sent to an email address provided by you. Please ensure that the email address you provide is accurate and valid as we will not be able to reissue or cancel an eGift Card that has been sent to an incorrect email address and which has been subsequently redeemed by another party.
13.6. In order to comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, we are required to undertake customer due diligence on all customers who wish to purchase $4,999 or more in Harvey Norman Gift Cards or other third party gift cards, in a single transaction or a series of related transactions. For individuals, customer due diligence can be done in store. For companies and other legal entities, please contact our Gift Card Team at nzgiftcards@nz.harveynorman.com.

14.1. We and our third parties, may collect personal information directly from you when you use the website, create an online account, place an Order, or when you contact us.
14.2. We recognise that your personal information is confidential, and we understand that it is important for you to know how we treat your personal information. For information about the personal information we collect from you, how we collect it, the purposes for which we use it and the third parties we may share it with, please refer to our Privacy Policy.
14.3. You agree that we and any of our third parties may use your email address to send you messages concerning your online account and any Orders you have placed. This also includes us sending you “commercial electronic messages” as defined in the Unsolicited Electronic Messages Act 2007, and information about the products sold via the website that we consider may be of interest to you, but only if you have separately consented to us doing so. You also agree that we may contact you by telephone or text to discuss your Order or to arrange delivery or collection.
14.4. If you would prefer not to receive promotional or other information from us or our third parties, please either use the unsubscribe facility in the applicable commercial electronic message or contact the Online Customer Services Team.
15.1. All of the terms of this disclaimer and indemnity will apply only to the maximum extent permitted by law. Nothing in this clause 15 will limit any rights you may have, or any obligations or liability we may have, that cannot be lawfully excluded under these Sales Terms, including those referred to in clause 15.5.

To the maximum extent permitted by law, and without limiting any express rights you may have under these Sales Terms, we and each of our related bodies corporate exclude all liability to you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to the website including, but not limited to, loss or damage you might suffer as a result of:
15.3. Except as expressly provided in these Sale Terms, and to the maximum extent permitted by the law, we and our third parties will not be liable for any direct, indirect, special, incidental, or consequential damages arising out of your access to or use of the website.

To the maximum extent permitted by law, you will at all times indemnify, and keep indemnified, us and each of our directors, officers and employees from and against any loss (including reasonable legal costs and expenses on a full indemnity basis), damages, penalties, fines, expenses, costs or liability incurred or suffered by us arising from any claim, demand, suit, action or proceeding by any person against you or them where such loss or liability arose out of, in connection with or in respect of your conduct or breach of these Sales Terms.
15.5. Nothing in these Sales Terms is intended to limit or exclude any rights, obligations or guarantees that cannot lawfully be limited or excluded under the CGA or Fair Trading Act 1986 (“FTA”). If and to the extent that any liability we purport to limit or exclude cannot be lawfully limited or excluded, these Sales Terms shall be modified to the extent necessary to give effect to the above intention.

If you are acquiring goods or services from us ‘in trade’, within the meaning given to that term in the CGA, to the maximum extent permitted by law, you agree that the guarantees provided in the CGA shall not apply to the supply of those goods and services, if it is fair and reasonable for you to be bound by this clause. We do not provide any express guarantees (as that term is defined in the CGA) other than those expressly confirmed in these Sale Terms or supplied to you in writing when you purchase goods and services from us.
16.1. Subject to clause 15.5, Harvey Norman will not be liable for any errors or delay in performing any of our obligations, including the supply of goods and services, if such errors or delays are caused by circumstances beyond our reasonable control, including but not limited to:

19.1. If any provision of these Sales Terms are determined by a court of competent jurisdiction to be invalid, illegal or unenforceable in any respect, the legality or validity of the remainder of the Sales Terms will not be affected and will continue in full force and effect.
20.1. These Sales Terms will be governed by and construed in accordance with the laws of New Zealand. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New Zealand to resolve any dispute arising in relation to these Sale Terms
21.1. We reserve the right to update these Sale Terms at any time, at our discretion, by publishing an updated version on our website. Any amendments will be effective immediately and will apply to any Order you place from the effective date of change. By continuing to use our website, you agree to be bound by these amended Sale Terms. We recommend reviewing the Sale Terms published to our website from time to time, and before placing an order, to understand the terms that apply to you.
