Harvey Norman Gift Cards Terms & Conditions

Definitions

  • Access Pin means the 4 digits located on the eGift Card or on the back of the Physical Gift Card or the Bonus Gift Card, marked as “PIN”.

  • Bonus Gift Card means a physical stored value gift card issued by the Issuer and supplied as part of a Bonus Gift Card promotion to a purchaser of selected products from Harvey Norman.

  • eGift Card means an electronic stored value gift card issued by the Issuer.

  • Expiry Date in respect of:

    1. A Physical Gift Card means the date occurring 36 months after the date the Physical Gift Card is first issued. The date of issue is indicated on the back of the card.

    2. A Bonus Gift Card means the date occurring two (2) months after the date the Bonus Gift Card is first issued. The date of issue is indicated on the back of the card.

    3. An eGift Card means the date occurring 36 months after the date of issue of the eGift Card. The date of issue is indicated on the card.

  • Gift Card means a Physical Gift card, a Bonus Gift Card, and an eGift Card.

  • Harvey Norman means Harvey Norman Stores (N.Z.) Pty Limited.

  • Harvey Norman Store means any Harvey Norman New Zealand physical store located in New Zealand. A list of stores can be located at www.harveynorman.co.nz

  • Holder in respect of a Gift Card means the person who is the purchaser, recipient, or user of a Gift Card.

  • Issuer means Harvey Norman Stores (N.Z.) Pty Limited.

  • Personal Information has the meaning given to that term in the Privacy Act 2020.

  • Physical Gift Card means a physical stored value gift card issued by the Issuer.

  • Privacy Act means the Privacy Act 2020.

  • System means the gift card system of the Issuer.

  • Terms and Conditions means these terms and conditions.

  • “You” or “Your” means a reference to the purchaser, recipient and/or user of the Gift Card.

  • “We” or “us” means a reference to the Issuer.

Terms and Conditions

  1. You agree to these Terms and Conditions when you purchase, receive, activate, are issued or use a Gift Card.

  2. If you purchase a Gift Card as a personal or business gift, or allow another person to use your Gift Card, you must tell that person that the use of the Gift Card is subject to these Terms and Conditions.

  3. We reserve the right to amend these terms and conditions at any time without notice. Any amendments will be made available online at www.harveynorman.co.nz.

  4. We reserve the right to correct any errors in the issuing of a Gift Card. If there is an error, we will endeavour to correct it as quickly as possible by cancelling the Gift Card and issuing a new one.

  5. We reserve the right to refuse to issue a Gift Card to any person and to suspend or cancel any Gift Card for any reason, at any time, without notice.

  6. These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand.

  7. Nothing in these Terms and Conditions are intended to exclude, restrict, or modify your rights under the Consumer Guarantee Act 1993, the Fair Trading Act 1986 or any other applicable laws.

Purchases

  1. Harvey Norman is the issuer of the Gift Cards.

  2. Physical Gift Cards can be purchased at any Harvey Norman Store or online at www.harveynorman.co.nz.

  3. Bonus Gift Cards are issued by Harvey Norman as part of a bonus gift card promotion. The Bonus Gift Card will be activated in the System only when you are in receipt of the products subject to the promotion.

  4. Bonus Gift Cards are issued on the original purchase of an eligible product.

  5. Bonus Gift Cards will not be issued for:

    1. ProductCare replacement sales;

    2. Insurance replacement sales;

    3. Commercial sales;

    4. Replacement products under the Consumer Guarantees Act 1993.

  6. Bonus Gift Cards will not be issued to employees, contractors and immediate family of employees and contractors of the Issuer.

  7. Bonus Gift Cards will be subject to the terms and conditions of the bonus gift card promotion. If there is a conflict between the terms and conditions of the promotion and these Harvey Norman Gift Card Terms and Conditions, the promotional terms and conditions will prevail.

  8. eGift Cards can be purchased online at www.harveynorman.co.nz and via our Corporate Gift Card Team by email at nzgiftcards@nz.harveynorman.com.

  9. A Gift Card can be loaded with a minimum value of $5 and a maximum value of $1,000.

  10. For purchases of Physical Gift Cards and online purchases of eGift Cards, we cannot sell more than $4,999 of Gift Cards to any individual, company, or other legal entity in a single transaction, or where there is a series of smaller and related transactions exceeding $4,999. This means you cannot purchase more than $4,999 worth of Gift Cards across multiple transactions. It is our sole discretion as to whether a series of online transactions are related.

  11. By purchasing online, you represent and warrant that you will not exceed the maximum purchasing limit and agree that Harvey Norman may cancel any online purchase or void any Physical Gift Card or eGift Card that breaches this limit.

  12. If you wish to purchase Gift Cards exceeding $4,999, please contact our Gift Card Team by email at nzgiftcards@nz.harveynorman.com.

  13. Purchases made with a Gift Card are as if the purchase was made by way of cash payment. Gift Cards are not legal tender, account cards, or credit or debit cards.

  14. Physical Gift Cards purchased online, where the total value of the transaction is $500 or less, will be delivered active and do not require activation by you. Gift Card orders over the value of $500 will require activation by you. To activate the Gift Card you will need to contact our Gift Card Team on (09) 261 4400 or by email at nzgiftcards@nz.harveynorman.com.

  15. eGift Cards purchased online will be issued to you active and do not require activation.

  16. Physical Gift Cards are only available for delivery to a residential or business address within New Zealand. They cannot be delivered to a P.O. Box.

  17. eGift Cards can only be issued to a valid email address.

  18. We will endeavour to deliver your Physical Gift Card and/or eGift Card within the recommended time frame outlined on our website during the ordering process. Any issues regarding the delivery of the Physical Gift Card or the issue of the eGift Card should be emailed to our Gift Card Team nzgiftcards@nz.harveynorman.com.

  19. To the extent permitted by law, we will not be liable to you or anyone else for any losses suffered or incurred due to delay in delivery or for lost or misdirected Gift Cards including where the incorrect delivery address or email address is provided by you at the time of purchase.

  20. Subject to payment, property and risk in the Gift Card passes to you upon receipt and activation of the Gift Card.

  21. We reserve the right to cancel any online purchase order for Physical Gift Cards or eGift Cards at any time, without notice, for any reason.

Using a Gift Card

  1. A Gift Card has no value unless activated in the System and payment has been made to the Issuer in respect of Physical Gift Cards. The System will be conclusive evidence of the balance, transaction history and expiry date of a Gift Card. No statements or transaction history will be sent to the Holder of the Gift Card.

  2. For added security your Gift Card has a unique 4 digit Access PIN number. If you have a Physical Gift Card or Bonus Gift Card, you can find your Access PIN on the back of the Gift Card under a scratch-off silver panel. For an eGift Card, the Access PIN will be contained in the Gift Card email sent to the recipient’s email address.

  3. A Gift Card’s Access PIN and card number is required to redeem a Gift Card online and to access the Gift Card balance.

  4. A Gift Card can be redeemed instore at any Harvey Norman Store within New Zealand and online at www.harveynorman.co.nz.

  5. A Gift Card cannot be redeemed at Harvey Norman Photocentre’s Online at www.harveynormanphotos.co.nz.

  6. A Gift Card can be redeemed in whole or for part payment of goods and services. No change will be given and any balance on the Gift Card may be used for future purchases. Gift Cards can only be used to make purchases up to the initial Gift Card amount, or the remaining balance. If the purchase price exceeds the balance of the Gift Card, the Holder must pay the difference using another payment method.

  7. Gift Cards can be used in conjunction with another form of payment, such as credit card or cash, to make up the full value of the purchase.

  8. Once a Gift Card has reached a zero balance it cannot be reloaded or re-activated.

  9. The Holder of a Gift Card may not consolidate the balance of several Gift Cards onto a new Gift Card.

Refunds

  1. Goods purchased using a Gift Card are subject to Harvey Norman’s exchange or returns policy. If you wish to return goods purchased with your Gift Card, it is not possible to reimburse funds to the original Gift Card. A new Gift Card will be issued.

  2. In the event that a Bonus Gift Card is awarded as part of a Harvey Norman Bonus Gift Card promotion, and the sale is later cancelled and goods are exchanged or cancelled, we retain the right to recover the full value of the Bonus Gift Card by return of the Bonus Gift Card, or, by way of deduction of the value of the Bonus Gift Card issued under the promotion from any refunded or credited amount.

Expiry Date

  1. The date of issue for Physical Gift Cards and Bonus Gift Cards are indicated on the back of the card and on the eGift Card. The expiry date for a Physical Gift Card and eGift Card will be 36 months from the date of issue and for a Bonus Gift Card, two (2) months from the date of issue. We are not responsible to users to redeem their Gift Card after the expiration date.

  2. After the Gift Card has expired, it is no longer valid. All transactions will be declined, and any remaining balance will become the property of Harvey Norman. Any remaining balance left on an expired Gift Card will not be refunded or reimbursed to the Holder.

  3. The Gift Card balance and expiry date can be checked at any Harvey Norman Store, online, or by emailing our Gift Card Team at nzgiftcards@nz.harveynorman.com.

Exclusions

  1. A Gift Card cannot be:

    1. used for online photo purchases at Harvey Norman Photocentre’s Online www.harveynormanphotos.co.nz

    2. used at Harvey Norman stores operating outside New Zealand;

    3. used to purchase another Gift Card;

    4. exchanged for a different domination of Gift Card;

    5. exchanged for a different type of Gift Card eg a Physical Gift Card for a eGift Card;

    6. used to purchase another type of gift card or prepaid card available at Harvey Norman Stores or online including but not limited to Steam, iTunes®, Xbox® and Playstation® gift cards;

    7. redeemed by phone or email;

    8. used in part payment of the transaction in which the Bonus Gift Card was issued;

    9. used to pay a Store credit account;

    10. used to pay an interest free repayment;

    11. used to pay any finance options offered by Harvey Norman.

  2. Gift Cards cannot be exchanged for cash or returned for a refund.

  3. The Gift Card remains the property of Harvey Norman and you cannot sell your Gift Card or assign any of your rights and obligations under these Terms and Conditions. The Gift Card may not be copied or reproduced in any circumstances. On expiry of the card, or once there is a zero balance, you may destroy the Gift Card.

Lost, Stolen or Damaged Gift Cards

  1. A Gift Card should be treated as cash. Lost or stolen Gift Cards will not be replaced, reissued, or refunded.

  2. Gift Cards will be void and will not be redeemable if they are defaced, altered, damaged, or tampered with in any way.

Liability

  1. You are responsible for the use and safety of a Gift Card at all times. It should only be given to an intended recipient for use. We will not be responsible if the Gift Card is used without your permission.

  2. Except for your rights under the Consumer Guarantees Act, the Fair Trading Act and the Privacy Act, our liability to you in connection with your Gift Card will be to the unused balance that remains on your Gift Card and to replacing a faulty Gift Card. We will not be liable to you in connection with your Gift Card for any damage or loss (including direct or consequential loss), or any loss of profits, loss of opportunity or loss of reputation.

  3. We will not be in default of these Terms and Conditions, for failure to observe or perform any of the obligations under these Terms and Conditions, for any reason or cause, which could not, with reasonable diligence, be controlled or prevented.

Privacy

  1. In accordance with the provisions of the Privacy Act, we may collect Personal Information from you at the time of purchase or redemption of a Gift Card. Personal Information collected through the Gift Card function is used only for the purpose of identification and other security related reasons. We will comply with the obligations set out in the Privacy Act in relation to the collection, security, access, use and disclosure of personal information. Harvey Norman’s Privacy Policy is available online at www.harveynorman.co.nz or by contacting the Privacy Officer at privacy.officer@nz.harveynorman.com.

  2. You consent to the collection and use of Personal Information by Harvey Norman when you purchase, receive, activate, are issued or use a Gift Card.

Activation of Gift Card, Enquires and Complaints

  1. If you wish to activate a Bonus Gift Card, please contact the Harvey Norman Store it was originally issued by, during store opening hours.

  2. For Gift Cards purchased online, please contact our Gift Card Team on (09) 261 4400 or alternatively email them at nzgiftcards@nz.harveynorman.com during the hours of 9.00am – 4.30 pm Monday to Friday.
